The Impact of EngineOwning Lawsuits on Online Gaming Communities

Activision filed a lawsuit in the United States against German companies EngineOwning UG and CMN Holdings S.A., several named defendants, and 50 ‘John Does’.

Activision claimed that the Call of Duty cheats sold by the defendants are copyright-infringing ‘circumvention devices’ and that trafficking in them is illegal under the DMCA. Furthermore, the gaming company alleged that selling the cheats to Activision customers constitutes contract interference and that selling cheats into the market amounts to unfair competition.

On the other hand, EngineOwning UG and ten named defendants describe Activision Blizzard as a $50 billion dollar company with offices around the world, including three in Germany. They note that ten of the defendants are German citizens living in Germany; yet, Activision chose to sue them in California for alleged conduct occurring entirely abroad, mostly in Germany. Additionally, the defendants reveal that Activision is already suing two of them in Germany, in a lawsuit filed at least a year before Activision’s United States lawsuit.

The motion claims that Activision’s allegations tend to be general in nature while targeting ‘unspecified defendants’. This extremely vague form of pleading makes it impossible to identify who did what, where, and when. Instead, the plaintiff leaves it to each defendant and the court to guess.

Overall, the ongoing activities damage Activision’s games, its overall business, and the experience of the COD player community. When players use exploits like the Cheating Software, such conduct disturbs game balance and often leads non-cheating players to quit matches in frustration. Moreover, widespread cheating can lead to negative social media posts and headlines in the press, which can adversely impact consumer confidence.

The defendants have violated Section 1201 of the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 1201(b)(1), by selling, importing, offering, providing, and otherwise trafficking in technologies that circumvent or evade anti-cheat technologies used by Activision to protect the integrity of the COD Games. They not only know that their conduct is unlawful, but they engage in it with the deliberate intent to harm Activision, its businesses, and its player community.

Activision has, and continues to invest enormous resources to combat cheating in its games. This lawsuit seeks to halt the unlawful conduct of an organization distributing and selling numerous malicious software products designed to enable the public to gain unfair competitive advantages.

As a result, the use of cheats from platforms like EngineOwning has led to frustration among honest players, many of whom leave games or lose interest, highlighting the negative impact on gaming communities. This lawsuit by Activision against EngineOwning seeks to address these issues and restore fairness in gaming.

Ultimately, Activision has secured a significant legal victory against EngineOwning, the cheat vendor. A federal court awarded $14.4 million in damages. This judgment marks a critical step in combating cheating in online gaming, which is essential for maintaining the integrity of gaming communities.
